Center for Health & Economy: Contingency plan for King v. Burwell protects health coverage

If the Supreme Court sides with the plaintiffs in King v. Burwell, Congress will be under pressure to enact a remedy that stabilizes health insurance markets and protects millions of people from losing their coverage. But that remedy should not simply undo the effects of the court’s decision. A group of nine health policy experts from various organizations have come together to develop a plan that meets the tests of policy, politics, and practicality. It would extend the exchange subsidies for a necessary transitional adjustment period, while giving states new options to reform their health insurance markets and offer better choices to their constituents. The proposal outlines where Congress has to finish, not necessarily where it will start, in negotiating an interim solution with the White House.

The Center for Health & Economy (H&E) has analyzed the proposal’s impact on health insurance coverage, medical access and productivity, and the federal budget, assuming that the Supreme Court will rule in favor of the plaintiffs. H&E finds that the alternative approach provides coverage at levels comparable to, and potentially higher, than ACA.
