We write to comment on the proposed regulation on smoke-free public housing, 80 Federal Register 71762 (November 17, 2015). Although we support the proposed requirement that public housing authorities prohibit the use of cigarettes and other lit tobacco products in public housing, we oppose any requirement or suggestion that public housing authorities prohibit electronic cigarettes (e-cigarettes).
An e-cigarette prohibition is unnecessary because e-cigarettes do not pose the same health risks as cigarettes. Indeed, by discouraging an effective option for public housing residents to quit smoking, a ban on e-cigarettes would harm public health and inflict financial costs on the economically disadvantaged residents.
If, contrary to our recommendation, HUD is inclined to impose a requirement that public housing authorities prohibit e-cigarettes, it should publish a second notice of proposed rulemaking (NPRM) and receive a new round of public comments before acting. It would be premature to include any such requirement in a final regulation based on the current NPRM, which offers only a cursory, grossly incomplete, and biased discussion of the issue.
