A suit seeking to keep U.S. District Court Judge Patricia Minaldi from managing her financial assets due to mental incapacity is making its way through state district court.
A notice for interdiction, which restrains an incapacitated person from managing his or her estate without the consent of a curator, was filed against Minaldi on March 16, according to Calcasieu Parish Clerk of Court records.
Kathleen Kay, who works under Minaldi as U.S. magistrate judge for the Western District of Louisiana, is named as the plaintiff. Local attorney Glen Vamvoras is listed as Minaldi’s temporary curator.
According to court documents, Judge Ron Ware on Friday granted an exception to Minaldi because she wasn’t served papers on a scheduled hearing in a timely manner.
Ware was assigned the case after Judge Clayton Davis recused himself March 16, citing Code of Civil Procedure Article 151, which says a judge must be recused when he “is biased, prejudiced, or interested in the cause or its outcome or biased or prejudiced toward or against the parties or the parties’ attorneys or any witness to such an extent that he would be unable to conduct fair and impartial proceedings.”
No further information on the case could be obtained Tuesday because all other court documents have been sealed. The American Press will file a motion today seeking to have them unsealed.
The suit comes just two months after Tony Moore, Western District of Louisiana Clerk of Court, told the American Press that Minaldi was on a “medical leave of absence” and would be absent from the bench for the foreseeable future.
Court records had shown Minaldi previously removing herself from more than two dozen cases since a trial she presided over in December ended abruptly. No specific reasons were given for why the cases were reassigned.
Minaldi, who has served as a federal judge since 2003, pleaded guilty in February 2014 to first-offense DWI. She was given a year’s probation, fined $400, plus $200 in court costs, and was ordered to attend church.
